Terms of Service

1. Acceptance of these Terms

These Terms of Service ("Terms") are a legal agreement between you and Alyara Apps Studio LLC, the operator of Lumara ("Lumara", "we", "us"). By creating an account or using the Lumara app, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app. Your download and use of the app from the App Store are also governed by Apple's Licensed Application End User License Agreement. If that agreement and these Terms conflict about the app license, Apple's agreement controls.

2. What Lumara is

Lumara is a personal tracker for aesthetic and self-care treatments. It lets you record treatments, providers, photos, notes and spending, and view insights based on the information you enter. Lumara is a personal log. It gives no medical advice. Ask your provider about your care.

Lumara is not a medical device and does not provide medical, cosmetic or health advice. Content in the app is for personal organization only. Always consult a qualified professional before making decisions about any treatment. Never disregard professional advice because of something in the app. Lumara does not check the information you enter. Insights, totals and reminders are calculations from your own entries. The "Share with my provider" PDF is your own record, not a medical record. In an emergency, contact emergency services or your provider.

3. Your account

You sign in with Apple. You are responsible for keeping your Apple ID and device secure and for all activity under your account. Provide accurate information, and keep it current. You must be at least 18 years old to use Lumara. By creating an account, you confirm that you are 18 or older. If we learn that a user is under 18, we may end the account and delete its data.

4. Subscriptions, trials, and billing

Lumara offers an optional paid plan, "Lumara Elite", as an auto-renewing subscription (monthly or annual) or as a one-time lifetime purchase. The price, the length of each plan and any free trial are shown in the app before you buy, in your local currency.

If a plan includes a free trial, the subscription starts when the trial ends unless you cancel at least 24 hours before the trial ends. Payment is charged to your Apple ID at confirmation of purchase, or at the end of the trial.

Subscriptions renew automatically for the same period at the price shown before you buy, unless you cancel at least 24 hours before the current period ends. Apple handles any price change and any consent it needs. You manage and cancel your subscription in your Apple ID Account Settings, not inside Lumara. You keep access until the paid period ends. Any unused part of a free trial is forfeited when you buy a subscription. The lifetime purchase is charged once and does not renew. "Lifetime" means for as long as Lumara is offered on the App Store. If we discontinue Lumara, lifetime access ends with the app. A free trial is available once per Apple ID, as Apple determines.

Purchases are processed by Apple under the App Store terms. Apple handles refund requests under its policies. You can ask Apple at reportaproblem.apple.com. Your legal rights stay in force. You can restore past purchases in the app.

5. Your content

You keep ownership of the treatments, photos, notes and other content you add ("Your Content"). You give us only the limited permission needed to store, process and display Your Content back to you so the app works.

You are responsible for Your Content and for having the right to store it. Do not upload content that is unlawful or that infringes another person's rights.

6. Acceptable use

Do not misuse Lumara. Do not try to access other people's data, disrupt the service, reverse-engineer the app except where the law allows, or use the app to break any law. We may suspend or end access that violates these Terms.

7. Disclaimers

Lumara is provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows. We do not promise that the app will be uninterrupted or error-free, or that the insights it shows are right for your situation. Lumara does not replace professional advice.

8. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental or consequential damages, or for loss of data or profits, arising from your use of Lumara. Nothing in these Terms limits liability for gross negligence or wilful misconduct, or liability that cannot be limited by law.

9. Termination

You may stop using Lumara and delete your account at any time (Profile, then Delete Account). We may suspend or end the service, or your access, if you breach these Terms or if we discontinue the app. If we end your access for a breach, Apple's refund policy applies to any paid period. How we handle your data when your account ends is described in our Privacy Policy.

10. Changes to these Terms

We may update these Terms as the app changes. If we make a material change, we will tell you in the app at least 30 days before it applies. If a change needs your consent, it will not apply until you agree. Changes do not remove rights you already earned. If you do not agree, stop using Lumara and delete your account before that date.

11. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. If you are a consumer in the EU or UK, you also keep the protection of the mandatory consumer laws of your country.

Nothing in these Terms limits any right that the law gives you as a consumer. If you live in the EU, the UK or another place with consumer laws, those laws give you rights that we cannot remove. You may also bring a claim in the courts of the country where you live. If a part of these Terms is not valid where you live, the rest stays in force.
